OPT to H1B Timeline: What to Expect

Transitioning from Optional Practical Training (OPT) to H1B status is one of the highest-stakes immigration moments for F1 students in the U.S. The window is tight, the lottery is unpredictable, and the consequences of missing key dates can be severe. This guide walks you through the complete OPT-to-H1B timeline so you know exactly what's coming and when.
The Two OPT Paths
Standard OPT: 12 months of work authorization after graduation. You apply for OPT through your DSO (Designated School Official) and receive an EAD (Employment Authorization Document) from USCIS.
STEM OPT Extension: If you graduated with a STEM degree (Science, Technology, Engineering, or Mathematics) and your employer is enrolled in E-Verify, you can apply for a 24-month extension of your OPT--giving you up to 36 months of OPT total.
Your path from OPT to H1B depends heavily on whether you have standard OPT or STEM OPT, because STEM OPT can bridge a second lottery cycle if you don't win on the first try.
The H1B Cap Lottery: When and How It Works
Annual H1B lottery timeline:
- October-November: USCIS announces rules for the upcoming H1B season
- January: Many employers begin evaluating H1B candidates
- March 1-20: H1B pre-registration window (electronic lottery registration with USCIS)
- Late March: USCIS runs the lottery and notifies selected registrants
- April 1-June 30: H1B petitions filed by selected registrants
- October 1: H1B employment can legally start for cap-subject cases
How the lottery works: USCIS runs a randomized computer selection. First, they run a draw for the 20,000 advanced degree (U.S. master's or higher) exemption slots. Then, all remaining registrations (including any not selected in the first draw) enter the general pool for the 65,000 regular cap slots.
Selection rates have ranged from 25% to 50% in recent years, depending on total registrations.
Cap-Gap: Your Bridge to October 1
If your OPT expires between April 1 and September 30 (the gap before your H1B start date), cap-gap automatically extends your F1 status and OPT EAD until September 30--or until your H1B petition is approved, whichever comes first.
Cap-gap requirements:
- You must have a timely filed H1B petition (your employer filed before your OPT expired)
- Your F1 status must have been valid when your employer's petition was filed
- Cap-gap only covers you if you won the lottery AND your employer filed a cap-subject petition
What cap-gap covers: Your F1 student status and work authorization are automatically extended. You do not need to apply for cap-gap--it's automatic by law. However, your DSO should issue an updated I-20 reflecting the cap-gap extension.
What cap-gap does NOT cover: Travel outside the U.S. during cap-gap can end your cap-gap protection. If you leave and return before your H1B start date, you may need to obtain an H1B visa stamp to re-enter in H1B status on October 1.
If You Don't Win the H1B Lottery
Losing the lottery is stressful but not the end of your U.S. journey. Your options:
1. STEM OPT extension (if eligible): If you have a STEM degree and your employer is E-Verify enrolled, file your STEM OPT extension with your DSO before your standard OPT expires. STEM OPT gives you 24 more months--enough to try the H1B lottery two more times.
2. Return to school (F1): Enrolling in another degree program resets your OPT eligibility (subject to STEM OPT cap rules) and keeps you in valid F1 status.
3. Change of status to B-2: This buys temporary non-work time. You cannot work in B-2 status, but it lets you remain in the U.S. while you plan your next steps.
4. O-1 visa: If you have extraordinary ability or achievement in your field, the O-1 visa is cap-exempt and can be filed at any time. Many OPT holders in specialized fields transition to O-1 while continuing to enter the H1B lottery.
5. L-1 visa: If you work for a multinational company with international offices, you might be eligible for an intracompany transfer (L-1) visa by working abroad for 1 year.
6. Depart the U.S.: If no other status is available, you may need to depart before your OPT expires to avoid overstaying.
Critical Warning: Status Gaps
The most dangerous scenario for OPT holders:
- Your OPT (initial + STEM extension) expires
- You were not selected in the H1B lottery, or your petition was denied
- You have not changed to another valid immigration status
In this case you are out of status. Continued presence in the U.S. accumulates unlawful presence, which triggers a 3-year bar (for 180+ days unlawful presence) or 10-year bar (for 1+ year) on re-entry after departure.
